Welcome to HerDate. These Terms of Service (“Terms”) are a legally binding agreement between you and HerDate governing your use of our website at gydate.com, the HerDate mobile application, and related services (together, the “Service”). By signing in with Google, creating a profile, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines.

1. Agreement to terms
These Terms apply to all visitors and registered users. Additional rules in the Community Guidelines are incorporated by reference. Using the Service after we post updates means you accept the revised Terms, except where we require a fresh consent in the app.
2. Eligibility & community
To use HerDate, you must:
- Be at least 18 years of age.
- Be legally able to enter a binding contract.
- Not be prohibited from using the Service under applicable law.
- Not have been previously banned from HerDate (unless we reinstate you).
HerDate is intended for women seeking connections with women, including lesbian, bisexual, queer, and other WLW identities. Users who join to harass, fetishize, or misrepresent their identity in order to deceive members may be removed. Respect for gender identity, sexual orientation, and pronouns is required.
3. Your account
- You create an account by signing in with Google. You are responsible for your Google account security and all activity under your HerDate profile.
- Provide accurate age, name (or honest display name), and location. Use photos that accurately represent you.
- One account per person. Ban-evasion accounts are not allowed.
- Do not share your account. You remain responsible for actions taken through it.
- We may require additional verification (for example photo or gender related checks) where offered; refusing required verification may limit features or lead to suspension.
4. Our services
HerDate provides profile discovery and browsing, filters, favorites, messaging (subject to free-tier limits), optional audio calls, premium features, referrals where available, and safety tools (block and report). We may modify, suspend, or discontinue features with reasonable notice where possible. We do not guarantee that you will find a match or that any particular user is available, honest, or compatible.
5. Acceptable use
You agree not to:
- Harass, threaten, stalk, bully, or abuse other users — including after rejection.
- Use hate speech, slurs, or attacks based on sexual orientation, gender identity, race, religion, disability, caste, or other protected characteristics.
- Out someone (reveal their LGBTQ+ identity or HerDate use) without their clear consent, or share private chats/photos to shame them.
- Post or send non-consensual intimate imagery (NCII), deepfakes, or explicit content involving anyone under 18.
- Impersonate others, catfish, use stolen photos, or misrepresent your gender/identity to deceive.
- Solicit money, run scams, phishing, MLM, escort/paid companionship ads, or commercial spam without our written permission.
- Scrape, reverse-engineer, hack, overload, or interfere with the Service; use bots or automated messaging.
- Use HerDate if you are under 18, or upload any content involving minors in a sexual context.
- Violate any applicable law or our Community Guidelines.
6. User content
You retain ownership of content you upload (photos, bio, messages). You grant HerDate a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and process that content solely as needed to operate, improve, secure, and moderate the Service.
You represent that you have the rights to post your content and that it does not violate others’ privacy or intellectual property. We may remove content that violates these Terms or the Community Guidelines, with or without notice. You are responsible for backing up anything you want to keep outside HerDate.
7. Premium & payments
Optional paid plans unlock extra features. Prices are shown in the app before you buy (for example Weekly ₹49, Monthly ₹149, Yearly ₹1,499) and may change. Billing is handled by Google Play and/or Stripe. Subscriptions renew automatically unless you cancel through the applicable store before the renewal date. Taxes may apply.
- Refunds follow the store’s or payment provider’s policies.
- Premium does not guarantee matches, preferential treatment in moderation, or immunity from these Terms.
- We may change premium benefits with notice; if a change is material, you may cancel according to store rules.
8. Safety & moderation
We provide block and report tools and may investigate reports. Actions can include content removal, warnings, temporary suspension, permanent bans, and — for illegal activity — referral to law enforcement. HerDate is not responsible for user conduct online or offline. You meet others at your own risk. Read our Safety Center before meeting in person.
If your account is restricted and you believe it was a mistake, email support@winkmeet.com with subject “Appeal — [your HerDate email]”. We aim to review appeals within 7 business days.
9. Third-party services
The Service integrates Google, Firebase, Agora, Stripe, Google Play, Supabase, and advertising services. Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for third-party outages or policies outside our control.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not guarantee uninterrupted service, error-free operation, matches, compatibility, or that users are who they claim to be. Online dating involves risk — never send money to strangers and never share sensitive financial details.
11. Limitation of liability
To the maximum extent permitted by law, HerDate and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising from your use of (or inability to use) the Service, user interactions, or third-party conduct. Our total liability for any claim relating to the Service shall not exceed the greater of (a) the amounts you paid us for Premium in the 12 months before the claim or (b) INR 5,000, except where liability cannot be limited by law (for example proven fraud or death/personal injury caused by negligence where such limits are prohibited).
12. Indemnity
You agree to defend and indemnify HerDate and its operators against claims, damages, and expenses (including reasonable legal fees) arising from your content, your misuse of the Service, or your violation of these Terms or others’ rights — except to the extent caused by our willful misconduct.
13. Suspension & termination
You may stop using HerDate at any time and request account deletion as described in the Privacy Policy. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a safety or legal risk. Upon termination, your right to use the Service ends immediately. Provisions that by nature should survive (including disclaimers, liability limits, indemnity, and governing law) will survive.
14. Changes to terms
We may update these Terms. Material changes will be posted with an updated date and may be communicated in the app or on the website. Continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service and delete your account.
15. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise. Courts in India shall have exclusive jurisdiction for disputes arising from these Terms, subject to any non-waivable rights you may have in your place of residence.
